These Terms of Service (“Terms”) govern your access to and use of the website located at petsearth.com (the “Site”) and your interactions with Pets Earth (“we,” “us,” “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1) About Our Business

We operate retail pet stores offering natural pet foods, grooming services, and toys/accessories (the “Services”). We do not currently offer online sales through the Site. Any prices, promotions, or product availability shown on the Site may differ by location and may change at any time.

2) Using the Site

You agree you will not:

  • Use the Site for any unlawful purpose
  • Attempt to gain unauthorized access to the Site or its systems
  • Introduce viruses, malware, or harmful code
  • Scrape, crawl, or interfere with the Site’s normal operation

4) Grooming and Appointments

Grooming appointments may be requested online or by phone/text/email/in store, but appointment times are not guaranteed and may change due to pet needs, safety, staffing, or emergencies.

For safety, we may refuse, modify, or discontinue grooming services if a pet’s behavior or condition could create a risk to the pet, staff, or others. You are responsible for providing accurate information about your pet, including any health concerns, sensitivities, or special handling needs.

5) Returns, Exchanges, and Store Policies

Returns, exchanges, and service policies may vary by product or service type and are governed by our posted store policies. Please see in-store signage (if applicable). Grooming fees may be subject to cancellation/no-show policies if you choose to add them.

6) Text Messages and Email Communications

If you choose to provide a phone number and/or email, we may use it to:

  • Administer a rewards program (if you enroll)
  • Send non-marketing messages related to grooming appointments (confirmations, reminders, changes)
  • Send marketing messages if you opt in (typically 1–2 promotional messages per month)

7) Intellectual Property

TO THE FULLEST EXTENT PERMITTED BY LAW, PETS EARTH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED $100 OR THE AMOUNT YOU PAID US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER, TO THE EXTENT PERMITTED BY LAW.

You agree to indemnify and hold harmless Pets Earth and its owners, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, violation of these Terms, or violation of any law or third-party rights.
